Fixed Payroll for Sole Proprietors, Partners Increases

Effective October 1, 2006, the fixed payroll for sole proprietors and partners increased from $35,100 to $43,800.

Fixed payroll is based on the average weekly wage set by the Texas Department of Insurance, Division of Workers' Compensation. As of October 1, 2006, the average weekly wage for fiscal year 2007 is $673.80, and it is subject to change on October 1, 2007.

The formula for calculating sole proprietors and partners’ payroll, per the Texas Basic Manual of Rules for Workers' Compensation and Employers' Liability Insurance, Rule V.F.3b, is:

Texas Mutual Pays Group Dividends

Texas Mutual Insurance Company is pleased to announce a $2,672,136 group dividend to the CompGroup AGC (AGC) Safety Group and a $773,720 group dividend to the Lone Star Auto Dealers Association (LSA) Safety Group.

AGC is open to most construction classification codes, and LSA is open to franchised auto, truck, boat, RV and motorcycle dealerships. Any licensed Texas agent can place qualifying clients into the groups, with the underwriters’ approval.

Agents who write with Safety Groups can increase their market share and develop a sound book of business. Texas Mutual Rolls Out Agent Network Support Program

Texas Mutual Insurance Company appreciates you for investing the time and resources to educate your clients about our workers’ compensation health care network option. The company recently introduced a program to recognize Texas-based agents for their efforts.

The program applies to existing policyholders choosing the network option between April 1, 2006 and March 31, 2007. For your efforts supporting the transition to networks, Texas Mutual will distribute to you an amount equal to approximately one-half percent of the policyholders’ premium that is associated with the remaining network term and the first renewal. Please remember that a key role of the agent in this education process is providing employers with the network packet as soon as possible so that the employer can begin rolling out the network option to their employees.

You can request endorsements for existing, eligible clients any time during their policy period. The easiest way to get a network endorsement for an existing, eligible Texas Mutual® policyholder is through our online services at www.texasmutual.com. You can also email your request to apps@texasmutual.com for new business or underwriting@texasmutual.com for endorsements; fax your request to (800) 359-0650; or mail your request to Texas Mutual Insurance Company, Attn: Underwriting, P.O. Texas Mutual Network Expansion Update

As noted in the August 21 FactsLine, the Texas Department of Insurance has approved the expansion of Texas Mutual’s workers’ compensation health care network. System changes necessary to implement the expansion are complete, and policyholders in the counties included in the expansion can now take advantage of this option.

To get an in-network quote for a new-business submission or an endorsement for an existing Texas Mutual® client, use the online services at www.texasmutual.com; email your request to apps@texasmutual.com for new business or underwriting@texasmutual.com for endorsements; fax your request to (800) 359-0650; or mail your request to Texas Mutual Insurance Company, Attn: Underwriting, P.O. Box 12058, Austin, TX 78711-2058.

If you have current, eligible out-of-network new and renewal quotes with effective dates starting on August 25, you can get a network quote by using our Internet Quoting (IQ) tool to request a requote. The system will provide an immediate quote with the in-network premium for eligible policyholders. Please do not enter comments when you request an IQ quote, as this will cause delays in processing your network quote. For quotes with effective dates on or after September 15, Texas Mutual will fax an in-network requote to your office for all current quotes affected by this expansion.

Texas Mutual® communications always instruct policyholders to contact their agents for more information. Texas Mutual will send a postcard to newly eligible policyholders around August 30 directing them to contact their agent if they would like to sign up for the network. The company will also notify current network policyholders who have locations within the expanded service areas.

Texas Mutual Expands Network Service Areas

The Texas Department of Insurance has approved the expansion of Texas Mutual’s Texas Star NetworkSM option. With the expansion, the network is now available to approximately 85 percent of the company’s policyholders. System changes necessary to implement the expansion are underway. We will notify you in the next two weeks regarding when the workers’ compensation health care network option will be available in the additional areas.

Texas Mutual Insurance Company encourages agents to promote the benefits of the workers’ compensation health care network option to their eligible clients. Policyholders who are eligible for and choose this option have access to occupational health care providers and case management services that help injured workers get well and back on the job. Most also earn a 12 percent annual network premium discount.

Save Mail Time
Policy Issuance Notification by Email Now Available

In response to agents’ requests, Texas Mutual Insurance Company launched its online policy issuance notification (OPIN) service. OPIN sends you email notifications when your policies are ready to be retrieved from www.texasmutual.com. You can then download high-quality copies and email or mail them to your clients.

To start receiving email notifications:

  1. Make sure you are registered to use Texas Mutual® online services. If you are not, click here, and complete the free, online application.
  2. Call the information services center at (800) 859-5995, or send an email to information@texasmutual.com. The email should include your agency code, the requestor’s name and phone number, and the email address you want your notifications sent to.

If you select OPIN and download policies, you are responsible for forwarding them to your clients in email or printed form.

Save more time! Texas Mutual® online services will now auto-process the workers’ comp health care network endorsement for eligible policyholders. Once a change request is submitted online to endorse the network on an eligible policy, Texas Mutual® online will auto-process the request immediately – saving you time!

Texas Mutual Pays $100 Million in Dividends

Texas Mutual Insurance Company began distributing about $100 million in individual dividends among approximately 34,000 policyholders today. Watch your mail for a list of your clients who will receive a dividend.

Policyholders enrolled in the Small Business Injury Protection and Cornerstone® programs are eligible to participate in the 2006 individual dividend plan, the largest in company history. This year’s plan includes the traditional annual and retention components. We are also awarding a special dividend based on our exceptional financial results in 2005 and an anniversary dividend in celebration of our 15 years of service to Texas.

Over the past eight years, Texas Mutual Insurance Company has distributed more than $320 million of individual dividends to qualifying policyholders.* Individual dividends are separate from the company’s Safety Group dividend program. Social Services Agencies of Texas

Texas Mutual Insurance Company is pleased to announce a $220,430 dividend for the Social Services Agencies of Texas (SSA) Safety Group. The group dividend is separate from the approximately $100 million in individual dividends the company will pay qualifying policyholders this year. Some SSA group members may receive dividends under both programs.

SSA is open to non-profit social services agencies. Any agent can place a qualifying client into the group, with the underwriter’s approval.

Texas Mutual to Award Record $100 Million in Dividends

This afternoon, the Texas Mutual® board of directors approved the company’s plan to distribute approximately $100 million in dividends among about 34,000 current, qualifying policyholders. The dividend plan, which still requires Texas Department of Insurance approval, represents the largest dividend payout in company history.

Texas Mutual Insurance Company has declared over $320 million in dividends to qualifying policyholders since 1999. State law prohibits the company from paying dividends to policyholders enrolled in the Start (insurer of last resort) program. Although Texas Mutual Insurance Company cannot guarantee dividends, the company is committed to putting money back into the economy and helping Texas businesses build for the future whenever possible.

As in the past, the 2006 dividend plan includes an annual component for qualifying customers whose policies expired in 2005 and a retention component for select, longtime customers. The board also approved a special dividend and anniversary dividend for this year’s plan. The special dividend is the result of Texas Mutual’s exceptional financial results in 2005. The anniversary dividend is in recognition of 15 years of service to Texas businesses.

Texas Mutual Unveils Interactive Safety Tools

Texas Mutual Insurance Company has added interactive tools to its safety resource center at www.texasmutual.com. The new tools help policyholders uncover and correct the root causes of workplace accidents. They also provide written safety programs designed around policyholders’ operations and allow them to track their progress toward completing recommendations made by their Texas Mutual® loss prevention consultant.

Texas Mutual Insurance Company encourages you to tell your Texas Mutual® clients about the new features. You can also remind your clients to visit the safety resource center to get free training material, calculate their incidence rate, read weekly safety topics and find out how much money accidents cost their business.

To use the system, policyholders should go to the safety resource center and enter their username and password. Policyholders who are not registered to use Texas Mutual® online services should complete the free online application.

Texas Mutual No Longer Receiving
Certificates of Insurance

Texas Mutual Insurance Company is no longer receiving and maintaining completed certificates of insurance. Effective May 3, 2006, we will discard any certificate of insurance we receive. As a reminder, you should never use a certificate of insurance to request changes to a policy.

TDI Amendments Affect Limited Partners

The Texas Department of Insurance (TDI) has adopted amendments to the Texas Basic Manual of Rules, Classifications and Experience Rating Plan for Workers’ Compensation and Employers’ Liability Insurance. As of April 22, 2006, limited partners can exclude themselves from workers’ comp coverage by policy endorsement. If they choose to be covered, the insurance carrier must charge them based on a fixed annual payroll. The current payroll is $35,100, and it is subject to change on October 1 of every year.

Texas Mutual Launches Workers’ Compensation Network Option

Texas Mutual Insurance Company is excited to announce that our new Texas Star NetworkSM option was certified by the Texas Department of Insurance on March 29. The Texas Star NetworkSM option will be available to eligible policyholders beginning on April 3. Eligible policyholders who choose the network will benefit from the network’s focus on appropriate medical care and getting their injured employees well and back to work. Most will also earn a premium discount of 12 percent.

Tell Your Clients About our New Online Tool

Texas Mutual Insurance Company has launched its DWC-3 Employers’ Wage Statement tool at texasmutual.com. The tool reduces cumbersome paperwork and helps your clients ensure that their injured workers receive timely, accurate income benefits.

The DWC-3 form provides wage information that Texas Mutual Insurance Company uses to calculate the injured worker’s benefits. If an employer knows that an injured employee is going to be off work or have reduced wages for eight days or more, the employer must file the form with Texas Mutual Insurance Company. Employers must also submit an updated DWC-3 within seven days of any information changing from the previous wage statement (such as discontinuing health benefits or other non-salary benefits initially continued after the date of injury).

The online DWC-3 tool prompts the employer for required data that will help ensure accuracy and reduce delays. Once the employer has completed the online form, the system automatically totals the information and sends it to the handling adjuster. The system also emails the employer a PDF version of the completed DWC-3 form for the employer to provide the injured worker and other parties, as applicable.

TRIA Extension Follow Up

In December 2005, Congress voted to extend the Terrorism Risk Insurance Act (TRIA) for another two years, in modified form. Texas Mutual Insurance Company will continue to provide TRIA coverage to all of our policyholders at no additional charge.

We are providing notice of TRIA coverage on the underwriting quote sheet. We will also include our revised, TDI-approved endorsement on policies with effective dates on or after January 1, 2006.

Texas Mutual Responds to TRIA Extension

In December 2005, Congress voted to extend the Terrorism Risk Insurance Act (TRIA) for another two years, in modified form. Texas Mutual Insurance Company will continue to provide TRIA coverage to all of our policyholders at no additional charge.

We are providing notice of TRIA coverage on the underwriting quote sheet. We are also filing a revised TRIA endorsement with the Texas Department of Insurance (TDI). Once TDI has approved our revised endorsement, we will include it on policies with effective dates on or after January 1, 2006.
