Other States Coverage
Texas Mutual Insurance Company is licensed to provide workers' compensation coverage only in Texas. We have partnered with Argonaut Insurance Company to offer workers' compensation coverage for Texas-based businesses that have permanent incidental operations in other states.
Other states coverage is not available to temporary agencies or professional employer organizations. Texas Mutual Insurance Company does not offer other states coverage for California, Kentucky, New York, North Dakota, Ohio, Washington, West Virginia or Wyoming.
If your client needs other states coverage in Florida, you will need to complete a special ACORD® application as required by Florida law. The application requires specific information that must be acknowledged and signed by the agent and owner/officer, and the signatures must be notarized.

All states are eligible for other states coverage, except for California, Kentucky and New York (and of course, Texas). Also, the so-called "monopolistic states" of North Dakota, Ohio, Washington, West Virginia and Wyoming are excluded from other states coverage. The monopolistic states are also ineligible for other states endorsements.

Florida has a special ACORD® application. The application has specific information that must be acknowledged and signed by the agent and owner/officer, and the signatures must be notarized. We will offer our quote using a standard application, but we will require the Florida application be completed within 30 days of the policy effective date. Contact your underwriter for a copy of the Florida application.

Texas Mutual is replacing its Other States Endorsement. Effective July 1, 2008, we will automatically apply the coverage provided in the new Limited Reimbursement for Texas Employees Injured in Other Jurisdictions Endorsement (TM-LRC-2008) to all policies at no additional charge. Actual endorsements will be attached upon issuance of a new or renewal policy. You do not need to complete a supplemental application.
If your Texas-based client sends Texas employees temporarily to other states, this endorsement provides reimbursement for expenses incurred to meet other states' workers’ compensation laws (subject to the terms and conditions of the endorsement).

An applicant for our other states program must be Texas-based policyholder to be eligible. Up to 35 percent of the policyholder's total governing class payroll can be in states outside Texas, regardless of the number of other states in which coverage is needed.

- Blanket waivers are not eligible for the following states:
- New Jersey
- North Carolina
- Pennsylvania
- Tennessee
Where available, blanket waivers will be charged on a per state basis. Minimum charge is $100 per state or two (2) percent of premium for blanket waivers. The same charge is applicable for specific waivers. This charge applies to each location where waiver is provided, subject to the state minimum premium charge.
- The other states policy will be written to expire with the Texas policy.
- Deposit Premium Guarantee Agreement (by prior arrangement ), account current (where approved), deposit premium combined with premium financing, or total payment must be sent in with the proposal acceptance form and invoice.
- We will provide coverage for known exposures at a physical location. Policies can not be written on an “If Any” basis. If no fixed locations or payroll currently exist we will use $1,000 minimum payroll in the same governing class code as the Texas policy. In this instance all of the premium is earned at policy inception.
- We will not provide coverage in other states for employee leasing companies, temporary employee providers or Start accounts.
- Rate filings may change between the time we quote the other states portion of the account and the time we issue the policy as required by the laws in the state where coverage is written. Please consider class code rates quoted as tentative.
- Other states quotes are good for six months from the date of issue.
- We require 30-day lead time to quote accounts with other states exposures.

- Lost Policy Receipt signed and witnessed on flat cancellations. Mid-term cancellations require insured’s signed request
