OIEC issues employer posting requirement
The Office of Injured Employee Counsel (OIEC) now requires employers who carry workers' compensation coverage to post notice of its ombudsman program in their workplace:
- Click here to download the notice.
- You must post the notice in your personnel office and where employees are likely to see it.
- The notice must be in English, Spanish and any language common to employees.
The OIEC is a state agency that represents injured workers' interests in the workers' comp system. The ombudsman program is a free service for injured workers who have a dispute with their workers' comp insurance carrier. For more information about the OIEC, visit www.oiec.state.tx.us.
DWC adopts disability management rules
The Texas Department of Insurance, Division of Workers' Compensation (DWC) has adopted new rules related to disability management. The rules, effective May 1, adopt The Medical Disability Advisor, Workplace Guidelines for Disability Duration as the official return-to-work guideline. They also adopt the current edition of the Official Disability Guidelines—Treatment in Workers' Comp as DWC treatment guidelines.
The new disability management rules are intended to improve communication among injured employees, health care providers, employers, insurance carriers and the DWC by establishing treatment guidelines, planning benchmarks, and return-to-work goals and time frames.
